Her insurance company may still end up eating this one & you could get your deductible back. It's ashame but some insurance carriers play this game & will deny your claim hoping that you or your insurance carrier won't feel like it's worth it to fight. My recommendation is to go through your company & pay you deductible. Save any receipts for any out of pocket expense (i.e. rental car). Once your claim is paid for, your carrier will subrogate against her carrier & will possibly take them to arbitration. KEEP ON TOP OF YOUR INSURANCE & make sure they do this. Tell them you want to be keep in the loop about the subrogation & when the arbitration is. Do not let them drop this! It may take a few months but you should win this & get you money back.

Also, look into contacting the insurance commission for your state. They should have a process for you to appeal her insurance comany's denial.

I had to help my brother go through this same process about 2 years ago. It took 6 months but he got his deductible back.

Thank you, I will push the issue with the insurance commission. Everyone feels so complacent, and I want to prove a point to this bitch and her insurance company. I am certain that I was definitely the victim with my car parked with the transmission in park.
It's not about the money, I can get the car fixed without spending my $500 deductible money out of pocket, I can actually get the car done in a few hours if I paint the bumper ahead of time.
I just don't want it paying out of my policy in the long run, it pisses me off that my policy has to pay out to cover their client's fault.

Got a call yesterday. My agent says that they are pursuing her insurance company as her being 100% at fault, and that her claim now is that I ran into the back of her, lol. I asked him if my policy has a lying sack of sh!t clause, lol. No biggie, the guy has to deal with pathetic liars all the time - even as obvious and slimy as this bitch. I'm laying in the weeds, but it's nice that I have an outlet for my hostility years down the road when I can come up with a way to make her life a living hell without her knowing why, lol.:D
Get this, she is on the staff at a local grade school. Real nice wholesome people there. Teaching grade school children that lying is bad:rolleyes:, I'll teach her a little Stranger Danger, lol.

You may have to wait a couple months, the azzhole quota is full in TN right now. Buddy of mine moving to NC this summer, should free up a couple slots. :crazy:
